Buy-back Terms
Version: buyback-1.5.0-2026-10-18-o63
Effective: 18 October 2026
These terms explain how you can sell a card from your vault back to Ohara. In short: if a card is in your vault and has not been put into a postage request, you can sell it back to us for berries. We show you exactly how many berries you will get before you confirm. The buy-back price follows the card's reference value locked for the week, at the rate shown with the price, and is never more than that weekly value (except for the 48-hour guarantee), credited at 1 berry = A$0.01. We guarantee the price shown for 48 hours after you draw a card. The berries land in your wallet immediately, in a single ledger entry, and the card becomes ours and goes back into our stock, where it may be included in a future pack. A completed buy-back is final. Berries you receive from a buy-back are Ohara's in-game currency like any other berries: they can only be spent on packs, have no cash value, and cannot be withdrawn as cash. Selling back is always your choice; you can keep any card or have it posted to you instead. We may change or suspend buy-back for the future, but never for a sale that has already been completed.
Draft for review. This document is a draft prepared for review and must be reviewed by an Australian legal practitioner before it is relied on.
Launch blocker: Legal identity incomplete. All unresolved fields are registered in unresolved.json; owner/counsel must resolve them before paid launch.
Current build: Ohara remains a demo/test service. No real money is collected and no real cards are sold or posted. Proposed paid-service procedures in this draft (including refunds on closure, support response times, spending controls and retention) require the bracketed owner decisions and implementation before launch. Account and privacy obligations still apply to information actually collected.

1. About these terms
1.1 Who buys from you. Buy-back is offered by UNRESOLVED: OPERATOR_LEGAL_NAME (ABN UNRESOLVED: ABN) of UNRESOLVED: REGISTERED_ADDRESS ("Ohara", "we", "us", "our").
1.2 How these terms fit with our other terms. These Buy-back Terms form part of your agreement with us, together with our Terms of Service, our Purchase Agreement and Sales Terms and our Privacy Policy. Words defined in the Sales Terms (such as card, vault, reference value, berries and postage request) have the same meaning here.
1.3 Which version applies. Each buy-back is governed by the version of these terms in force when you confirmed it.
1.4 Your consumer rights. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
2. What buy-back is
2.1 A sale of your card to us. A buy-back is a sale by you, to us, of a card that you own and that we are holding in your vault. In return, we credit berries to your Ohara wallet.
2.2 Always optional. You never have to sell a card back. Every card in your vault stays yours until you sell it back to us. Delivery to you does not end your ownership. Instead of selling it back, you can keep it in your vault or ask us to post it to you under the Purchase Agreement and Sales Terms.
2.3 Not a cash service. Buy-back pays in berries, not money. Berries are Ohara's in-game currency, with the features and limits set out in our Terms of Service, clause 7: they can only be spent on packs and have no cash value. In particular, berries cannot be withdrawn, cashed out or transferred.
3. Which cards can be sold back
3.1 Eligible cards. You can sell a card back if all of the following are true at the moment we process the sale:
- (a) the card is yours and is held in your vault;
- (b) the card has fully settled into your vault (for example, it is not still reserved while the payment for the opening that drew it is being confirmed);
- (c) the card is not in a postage request (see clause 3.2);
- (d) the card is not on hold (for example, because it is being investigated as damaged, missing or the subject of a dispute);
- (e) the card has not already been sold back;
- (f) we currently display a reference value for the card that is greater than zero;
- (g) your account is active (not suspended, restricted or closed); and
- (h) buy-back is available (we have not suspended it under clause 9).
3.2 Cards in a postage request. Once you confirm a postage request, every card in it is locked to that request and cannot be sold back, including while the request is waiting to be packed, after it has been packed or shipped, and after it has been delivered. If you cancel a postage request before it is packed, the cards return to your vault and can be sold back again.
3.3 Why a card cannot be sold. If a card cannot be sold back, the vault tells you why (for example, "in a withdrawal (shipping to you)" or "not settled in your vault yet").
4. The buy-back price
4.1 You see the price before you sell. Before you confirm a sale, we show you the buy-back price for each card you have selected, in berries and in Australian dollars, and the total for your selection.
4.2 How the price is set. The buy-back price is the card's reference value locked for the week when we process your sale, at the buy-back rate we show you with the price (at the date of these terms, 100% for most cards), and - except where clause 4.4 guarantees a higher price - never more than that weekly reference value. For a card our price feed does not yet cover, the buy-back price is the reference value we display for it. Either way it is credited at 1 berry = A$0.01, and you see the exact amount before you confirm (clause 4.1). If we change how the buy-back price is set, clause 9 applies. UNRESOLVED: BUYBACK_RATE_BASIS
4.3 About reference values. Reference values are explained in the Purchase Agreement and Sales Terms, clause 9. In short, they are our own figures for a printing of a card, derived from third-party market data and locked each Monday at 00:00 Australia/Melbourne (AEST or AEDT) for the week. Daily market updates are internal only. They are not an appraisal of your copy, and they are not a promise of what you could get for the card elsewhere. A card's reference value can go up or down between the time you draw it and the time you sell it.
4.4 Your price is guaranteed for 48 hours. When you draw a card, we record the buy-back price we show you for it at that moment and guarantee it for 48 hours from the draw. If you sell that card back to us within those 48 hours, you receive the higher of that guaranteed price and the buy-back price at the time of your sale: a fall in our reference values cannot reduce it, and a rise can still increase it. Your vault and the reveal show the guaranteed price and when the guarantee ends. After the 48 hours, the sale uses the buy-back price current at that time (clause 4.2), and values can go down as well as up. UNRESOLVED: VALUE_LOCK (enforced by the application from release r21; confirm the wording and how it is disclosed with counsel.)
4.5 Whole berries. Reference values are kept in whole cents, so a buy-back always credits a whole number of berries.
4.6 Cards drawn before 5 October 2026. Before 5 October 2026 we did not record the guaranteed price with each draw. So that a card drawn before then is never bought back inside its 48 hours at less than the price you were shown, it can be sold back only once 48 hours have passed since you drew it; it then sells at the buy-back price current at that time (clause 4.2). Until then, your vault shows when it can be sold.
5. How to sell a card back
5.1 From your vault. In your vault, select one or more eligible cards and press the sell button. The total you will receive is shown before anything is sold.
5.2 After a multi-pack run. At the end of a run, you can pick cards from the results board and sell them back in the same way.
5.3 Selling several cards at once. When you sell several cards together, each card is processed as a separate buy-back, with its own reference and its own ledger entry. If one card cannot be sold (for example, because it became ineligible), that card is not sold and stays in your vault, and the others are unaffected. Your screen shows which cards were sold.
5.4 No double sales. Every buy-back request carries a unique reference. If your connection drops and your device sends the same request again, our systems recognise it: the card cannot be sold twice and the berries cannot be credited twice.
6. When the berries are credited
6.1 Immediately. When a buy-back succeeds, all of the following happen together, at the same moment, in a single transaction:
- (a) ownership of the card passes from you to us;
- (b) the card leaves your vault;
- (c) the buy-back price is credited to your berry balance as one ledger entry (for example, "Sold back [card name] ([card number])"); and
- (d) the card is returned to our stock.
If any part of this cannot be completed, none of it happens: the card stays yours and in your vault, and no berries are credited.
6.2 Your receipt. Your screen shows a confirmation of the sale and your new balance. Every buy-back is recorded in your ledger with the card, the berries credited and the time.
7. What happens to the card
7.1 The card becomes ours. On a successful buy-back, the card becomes our property, free of any claim by you.
7.2 It goes back into our stock. Bought-back cards return to our stock. We may include them in the pool of a future pack revision, where they can be drawn by any customer (including you). A bought-back card does not reopen a pack revision that has already closed; if it is used in a restock, it is published as part of a new revision with its own disclosed odds, as explained in the Purchase Agreement and Sales Terms.
8. Buy-backs are final
8.1 No reversal on request. Once a buy-back has succeeded, you cannot cancel or reverse it, and we cannot sell the same card back to you. The only way to get that card again is to draw it from a future pack in which it is included, or to obtain another copy elsewhere.
8.2 Genuine errors. If a buy-back was credited at a price that was plainly wrong because of a technical fault (for example, a data error that displayed a value many times higher, or lower, than the card's actual market value), we may contact you within 14 days of the sale to correct it. We will explain the error and, with your agreement, either reverse the buy-back (returning the card to your vault and removing the berries credited) or adjust the credit to the correct value. If you do not agree, we will not debit your balance merely because a complaint period has elapsed; any correction must be agreed or have a lawful basis. You can raise the matter through our complaints process (Terms of Service, clause 21). We will never correct a price simply because market values moved after your sale. UNRESOLVED: ERROR_CORRECTION (confirm this clause with counsel; see the R8 legal review register.)
9. Changes to buy-back
9.1 We may change or suspend buy-back for the future. For the reasons in Terms of Service clause 20.1, and subject to its notice and non-retrospectivity safeguards, we may change the rules for future buy-backs or suspend the service where reasonably necessary. Any reduction affecting cards already bought or berries already paid for needs review under consumer law; this clause does not authorise an unfair unilateral change.
9.2 Notice. We will give you at least UNRESOLVED: BUYBACK_CHANGE_NOTICE_DAYS days' notice before a change that makes buy-back less favourable to you (such as a lower percentage of the reference value) takes effect, by email and on our site, unless we need to act sooner for a legal, security or integrity reason (for example, a data fault affecting reference values, or suspected fraud). A temporary suspension for those reasons can take effect immediately; we will tell you about it on the site.
9.3 Completed sales are never affected. A change or suspension never affects a buy-back that has already been completed.
9.4 Your cards stay yours. If buy-back is suspended or ended, your cards remain yours, in your vault, and you can still ask us to post them to you.
9.5 Check the current quote. The screen shows the current buy-back quote, the guaranteed price and when the 48-hour guarantee described in clause 4.4 ends. The application enforces the 48-hour price guarantee from release r21; confirm the wording and how it is disclosed with counsel. UNRESOLVED: VALUE_LOCK
10. Fair use
10.1 What is not allowed. You must not use buy-back:
- (a) to sell a card you know, or should reasonably suspect, was obtained through fraud, a payment you are not entitled to make, or a payment you intend to reverse;
- (b) to exploit a pricing or technical error you know about or should reasonably recognise;
- (c) through automated tools, scripts or bots; or
- (d) as part of any scheme to launder money or disguise the source of funds.
10.2 What we may do. If we reasonably suspect misuse of buy-back, we may refuse or delay a buy-back, temporarily suspend buy-back on your account while we investigate, and take the other steps set out in our Terms of Service. We will tell you what we are doing and why, unless the law prevents us or telling you would prejudice an investigation.
11. Tax
11.1 We cannot give you tax advice. If you sell cards regularly, or in large amounts, you may wish to get independent advice about whether that has any tax consequences for you.
12. Demo mode
12.1 While Ohara operates in demo mode (see the Purchase Agreement and Sales Terms, clause 15), buy-backs are demonstrations only: no real card is owned or sold and demo berries have no monetary value. Privacy rights and other non-excludable rights still apply.
13. Contact
13.1 If you have a question about a buy-back, contact us at UNRESOLVED: SUPPORT_EMAIL and include the card name and the time of the sale from your ledger. Complaints are handled under our Terms of Service, clause 21.
Version buyback-1.3.0-2026-10-05. Effective 5 October 2026. Earlier versions are kept on record and are available on request.
